These Terms of Service ("Terms") govern your access to and use of the Consoly mobile application and related services (the "App"). By using the App, you agree to be bound by these Terms.

If you do not agree with these Terms, do not use the App.

1. Who We Are

You must be at least 13 years old, or the minimum legal age in your jurisdiction, to use the App. By using the App, you represent that you meet this requirement.

3. Account Registration

You may use the App anonymously or sign in using an authentication provider such as Apple or Google. When you create an account, you agree to provide accurate information and to keep your credentials secure.

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to gain unauthorized access to the App, its servers, or related systems.
  • Interfere with or disrupt the App or its infrastructure.
  • Use automated tools, bots, or scripts to interact with the App.
  • Exploit bugs, vulnerabilities, or unintended behaviors in the App.
  • Impersonate another user or misrepresent your identity.
  • Share, publish, or distribute content obtained from the App in violation of these Terms.
  • Circumvent restrictions, limits, or security measures implemented in the App.

We reserve the right to suspend or terminate your account if you violate these Terms.

5. Usernames and Public Content

You may choose a username that will be publicly visible on leaderboards and within the App. You agree that your username will not contain offensive, misleading, or inappropriate content.

We reserve the right to remove or require changes to usernames that violate these Terms or our standards.

6. Intellectual Property

All content in the App, including but not limited to code challenges, text, graphics, logos, icons, and software, is owned by or licensed to Consoly and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from any content in the App without prior written permission.

7. Subscriptions and Purchases

7.1 In-App Purchases

The App may offer premium subscriptions ("Consoly Pro") through the Apple App Store or Google Play Store.

7.2 Billing

Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase. Subscription prices are displayed in the App and may vary by region.

7.3 Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

7.4 Managing Subscriptions

You can manage and cancel your subscription at any time through your device's App Store or Google Play settings. Cancellation takes effect at the end of the current billing period.

7.5 Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. Consoly does not process refunds directly.

7.6 Free Trials

If a free trial is offered, the trial period is specified at sign-up. If you do not cancel before the trial ends, you will be automatically charged for the first subscription period.

8. Rewarded Ads

The App may offer rewarded advertisements that allow you to unlock content or features. Viewing an ad does not guarantee availability of rewards at all times, and ad availability may vary.

9. Streaks, XP, and Rankings

Streaks, XP, scores, rankings, and other gameplay metrics are for entertainment and engagement purposes. We reserve the right to modify, reset, or adjust these metrics at any time for any reason, including but not limited to preventing abuse or maintaining fairness.

10. Account Deletion

You may request deletion of your account at any time through the App or by contacting us at support@consoly.app.

Upon deletion:

  • Your account data will be deleted or anonymized as required by applicable law.
  • Some data may be retained for legal, security, or operational purposes where permitted.
  • Deletion is permanent and cannot be reversed.

Active subscriptions are not automatically cancelled upon account deletion. You must cancel your subscription separately through the App Store or Google Play.

11. Availability and Modifications

We strive to keep the App available and functional, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the App or any of its features at any time without prior notice.

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the "Last Updated" date above. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Consoly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App.

14. Indemnification

You agree to indemnify and hold harmless Consoly, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or related to your violation of these Terms or your use of the App.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Consoly operates, without regard to its conflict of laws provisions.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
